A. FINDING that awarding a design-build contract pursuant to Public Utilities Code Section 130242 (a) will achieve certain private sector efficiencies in the integration of design, project work, and components related to electrification for the Division 20 Portal Widening Turnback Project; and

B. AUTHORIZING the Chief Executive Officer to solicit and award a low bid design-build contract for the electrification improvements required for the Division 20 Portal Widening Turnback Project, pursuant to Public Utilities Code Section 130242.

ISSUE
Metro is authorized to enter into design-build contracts pursuant to Public Utilities Code Section 130242. This section requires that the Board make the finding set forth in Recommendation A. This action is in conformance with Metro's typical business process and procedures for award of low-bid design-build contracts.
Discussion
DISCUSSION
The primary benefit of the design-build process is a shortened project schedule where the design-builder is able to start construction while the design is being completed. For the Division 20 Portal Widening Turnback project, a separate design-build contract to complete design, manufacture, furnish, and test the new traction power supply substation and emergency backup power generator in the Red/Purple Line Yard is critical before the main portal widening and turnback facility construction can commence. The proposed location of the turnback facility directly impacts the existing power substation and emergency backup power generator. The turnback facility cannot be built until the new power substation is constructed and tested and the existing one is removed.
Implementing a design-build delivery method for the electrification of the Div 20 Portal Widening Turnback Project ensures Metro will meet the revenue service date for Purple Line Section 1 per the Federal Funding Granting Agreement. Other possible benefits of a design-build process include additional efficiencies in project management, administration, and coordination.
Award for this design-build contract will be made on a low-bid basis.
Financial_Impact
FINANCIAL IMPACT
This project is funded on a fiscal year basis under project number 865519 - Division 20 Portal Widening Turnback Project. No additional funding is required for the proposed recommendation. Funding for the procurement activities are included in the approved budget of $76.9M through FY18. Staff will develop a Life of Project (LOP) budget recommendation as designs are finalized and a contract award amount is eminent for the primary workscope. The Project Manager, Cost Center Manager and Chief of Program Management is responsible for budgeting in future fiscal years.
Impact to Budget
The FY18 budget is funded with Measure R 35% and State Transit and Inter City Rail Capital Program (TIRCP) sources. These funding sources are designated for this project and does not have an impact to Operations eligible funding. No other funds were considered.
Alternatives_Considered
ALTERNATIVES CONSIDERED
This work could be accomplished under the main construction contract when that solicitation goes out for bid. Staff does not recommend this approach because doing so would extend the construction duration of the portal widening and turnback facility by at least another 12-14 months, thereby jeopardizing the FFGA for Purple Line Extension Section 1.
