AUTHORIZE Contract Modification No. 184 by Caltrans for construction contract of the Segment 4 of the I-5 North Capacity Enhancements Project between SR-134 and SR-118 (Project) under the Funding Agreement No. MOU.P0008355/8501 A/A6, in the amount of $1,219,548.11.
Issue
ISSUE
The I-5 North Capacity Enhancement Project includes freeway widening and construction of HOV lanes and other improvements between SR-134 and SR-118. The project is divided into four segments. Segment 4 is between SR-134 and Magnolia Street. The total Project budget for Segment 4 is $106,756,000 of which $68,956,000 is federal funds (RSTP and CMAQ) and $37,800,000 is local Prop C and Measure R funds. CMAQ funds are programmed through Metro.
The State of California, Department of Transportation (Caltrans) owns, designed, and is managing construction of the Project. The original steel girder fabrication window for Providencia Bridge had a scheduled start date of October 4, 2011, which was delayed due to survey and design issues leading to the contractor’s inability to fabricate the girders.
In May 2016, Metro Highway Program staff worked closely with Caltrans and its Contractor to reach a resolution wherein the Contractor committed to expedite the fabrication of girders with an estimated schedule saving of 11 months, moving the date of completion of the Project up from May 31, 2019 to June 29, 2018. The negotiated cost of the Contract Modification No.184 is $1,219,548.11. If this Contract Modification is not approved, delay would result in $4,019,200 in expenditures through completion of the project. This Contract Modification will save a net of $2,799,652. Contract modifications exceeding $500,000 require Board authorization per the Staff Delegations of Contract Action Approval and Award Authority Memo, dated February 23, 2010.

Financial_Impact
FINANCIAL IMPACT
The total programmed budget of construction capital and support cost for this project is $106,756,000. The original contingency was $13,477,000 $21,946,000. The remaining contingency after Contract Modification No. 184 is $3,551,499 $9,200,000 which is about 26.3% 41.92% of the original budgeted contingency with 67% of the construction work completed.
The total cost of this Contract Modification No. 184 does not require an increase in the overall budget, as it will be funded from the current project budget. Caltrans will pay the cost of this work from the Project CMAQ funds. This expenditure will not impact the local funds in the project budget.
Since this is a multi-year contract/project, the Senior Executive Officer of Highway Program will be responsible for budgeting the cost in future years.
Alternatives_Considered
ALTERNATIVES CONSIDERED
The Board may choose not to approve the staff’s recommendation. However, this disapproval would result in further schedule delays and cost overruns.
Authorization of Contract Modification No. 184 in the amount of $1,219,548.11 will allow Caltrans to complete the work on Providencia Bridge and prevent the 11-month project delay and the cost associated with the delay.

Upon Board’s approval of the recommended action, Metro staff will coordinate with Caltrans to pay Contractor’s invoices upon receipt.
